Court directs officials to evict tribal encroachers in Wayanad

Kochi: Kerala High Court has asked authorities to evict within a month certain tribal people who had encroached upon private estates in Waynad. The directive to the Waynad District Magistrate and the Superintendent of Police was issued by a division bench comprising Justices K M Joseph and M L Joseph Francis while disposing of petitions filed by Janata Dal MLA M V Shremyams Kumar, RPG Group company Harrisons Malayalam and two others. The court, while extending the police protection for the estates, said "if the state is overwhelmed by lawlessness, it does not require much imagination to conclude that all the so called precious rights which are declared sacrosanct under the Constitution will perish". It was the bounden duty of state to ensure that it dealt with lawlessness in an appropriate manner, but firmly. Police could not shirk their responsibility to act, the bench observed. It opined that tribals, however laudable their objectives are, could not act in an illegal manner. The tribals led by a pro-CPI(M) outfit had occupied the land in February alleging that these had been encroached by the complainants.
